Terms of use for Short Clip Services
Upon your subscription or registration for our IPTV application services provided by Phataraphong Phanasaensukjai (hereinafter referred to as 'We'), which offers various functions such as live TV VOD, Short, and etc.
As we have recently introduced a new service feature called Short Clips, we have formulated specific terms and conditions governing the usage of this service between you and us. These terms aim to ensure personal usage without commercial intent, regardless of the device or method employed. By accepting these terms, you acknowledge and agree to abide by them as of the effective enforcement date.
1.Definitions
"Short Clips" refers to videos that you create, produce, or obtain from other sources, and then share with other users within the Short Clips service in compliance with the law.
"Your Information" refers to personal data or any electronic information that you submit to the Short Clips service. You must be the rightful owner and/or have the legal rights and authority to use the information, in whole or in part, as permitted by law.
"Intellectual Property" refers to copyrights, patents, trademarks, service marks, and any other intellectual property rights recognized by law.
"Force Majeure" refers to unforeseeable circumstances as defined by Thai law, including events beyond our control, such as network or system failures, internet or communication disruptions, and similar occurrences.
"Effective Enforcement Date" refers to the date on which we accept your subscription or registration.
2.Your Relationship with Us
You acknowledge and understand that the provision of the Short Clips service is part of the IPTV application services. Therefore, you willingly accept and agree to comply with the terms and conditions stated herein, as well as any future enforceable announcements made by us. These terms and conditions are an integral part of our service agreement. In the event of any contradiction between these terms and the aforementioned service agreement, you shall adhere to these terms unless otherwise notified by us.
3. Your Account
You certify that you will create an account with us and provide accurate and up-to-date information. You are responsible for maintaining the confidentiality of your account and password, and you are liable for all activities carried out under your account However, we reserve the right to suspend your account at any time if you violate these terms and/or breach any applicable laws related to these terms.
Limitations on the Use of Short Clips Service
You must:
4.1 Use the service solely for personal activities and not for commercial purposes.
4.2 Not upload any data that infringes intellectual property laws, other laws, or ethical standards.
4.3 Not interfere with the operation of the IPTV application service.
4.4 Not harass or threaten others, promote explicit sexual content, violence, discrimination based on race, nationality, gender, religion, Royal family, disability, age, or sexual orientation.
4.5 Not use another person's account without permission, create fake profiles, or impersonate others.
4.6 Not write fake reviews.
4.7 Not upload files containing viruses or any technologically harmful materials, and not upload other people's personal data without their permission.
4.8 Not incite hatred, anger, or revenge that may lead to illegal actions.
4.9 Not use offensive or provocative language, cause distress, humiliation, embarrassment, or anxiety.
If you violate any of these conditions, we reserve the right to suspend your access to the Short Clips service, in whole or in part, without prior notice.
5.Data Upload in the Short Clips Service
5.1 The data you upload to the Short Clips service must comply with applicable laws.
5.2 If we generate any revenue or benefits from the data you upload to the Short Clips service, you are not entitled to any share unless otherwise agreed upon.
5.3 We do not guarantee that the data within the Short Clips service is accurate, complete, or up to date. Additionally, we are not responsible for screening or verifying the data displayed in the Short Clips service.
5.4 The data you upload to the Short Clips service is not considered confidential.
5.5 You do not have the right to revoke permission for us to use the data you upload to the Short Clips service without compensation.
5.6 We have the right to modify or change the data you upload to the Short Clips service as we deem necessary.
5.7 You have the right to provide suggestions or feedback to us for the improvement of the Short Clips service. However, we are not obligated to act upon your suggestions, and feedback is not considered confidential.
6.Violation and Termination
6.1 If you violate these terms and conditions, we have the right to provide you with an appropriate notice to rectify the situation within a reasonable time. Failure to comply may result in the cancellation of your use of this service.
6.2 We may immediately terminate your use of the service based on these terms and conditions if it is found that you have violated a significant provision.
6.3 Regardless of whether we exercise our rights under section 6.1 or 6.2, you agree to compensate us for any damages incurred as a result of your violation of these terms and conditions.
7.Limitations and Disclaimers
7.1 We do not guarantee uninterrupted, timely, secure, or error-free access to the Short Clips service.
7.2 We are not responsible for any damages incurred to the data you upload to the Short Clips service, including but not limited to deletion, alteration, modification, or preservation of such data.
7.3 We cannot guarantee that our service will be secure or free from bugs or viruses. It is recommended that you use your own antivirus software for protection.
8.Other Terms and Conditions
8.1 These terms and conditions are governed by the laws of Thailand.
8.2 We reserve the right to modify or amend these terms and conditions as deemed appropriate, without prior consent from you. We will notify you of any changes.
